Terms And Conditions

Eligibility

1. This competition is only open to Eligible Participants. An Eligible Participant is a person aged 18 years or over (or such age as it required for the Promoter to lawfully contract with you in the jurisdiction in which you are resident) who is not an employee of British Airways Plc (“BA”), Cedar Communications, Small Luxury Hotels™ or any of their affiliates. Proof of age will be required before prizes are awarded. The Promoter reserves the right to verify the eligibility of Eligible Participants. By taking part in this promotion Eligible Participants confirm that they accept the terms and conditions below.

2. This competition is subject to all applicable national, federal, state, and local laws and regulations. It is your responsibility to ensure that you comply with the laws that govern you in the jurisdiction in which you are resident. Your participation in this competition is at your sole option and risk. Competition void where not valid or prohibited. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. Before entering, participants must ensure that they are able to arrange and take the Ultimate Prize, should they win. Note that the prize flight departs from London and the winner must be able to get themselves to London for the flight, at their own cost. If you are unable to do so, please do not enter.

Opening and closing dates

1. The competition consists of three separate Seasons. The opening and closing dates for each Seasons are as follows:

  • Season 1 (3rd January 2012 – 29th February 2012), midnight GMT
  • Season 2 (1st March 2012 - 30th April 2012), midnight GMT
  • Season 3 (1st May 2012 - 30th June 2012), midnight GMT

How to enter

1. Eligible Participants may enter once per Season – no bulk entries are permitted. Any further entries and anyone found trying to circumvent these rules will be disqualified. Entries must not be sent through agencies or third parties.

2. To enter, Eligible Participants must visit the photography competition page on www.bahighlife.com and upload their photograph, before the relevant Season’s closing date (as set out at clause 3 above). The following formats are accepted: GIF, JPEG, JPG and PNG. Participants will also be required to enter their name, email address, hometown, title of the photo, location and month/year taken.

3. All images submitted must be the work of the individual submitting them and must not have been published elsewhere or have won a prize in any other photographic competition. It is the responsibility of each entrant to ensure that any images they submit have been taken with the permission of the subject and do not infringe the copyright of any third party or any laws. Entrants must warrant that the photograph they are submitting is their own work and that they own the copyright in it.

4. The competition is moderated, and images will be loaded at the judge’s discretion. The Promoter reserves the right to remove images that have not been submitted correctly or that are deemed inappropriate, at its sole discretion.

Lost/incomplete entries/website malfunction

1. Late, illegible, incomplete, defaced or corrupt entries will not be accepted. BA, Cedar Communications and Small Luxury Hotels™ accept no responsibility for damage or loss resulting from misdirected or incomplete entries arising from computer malfunction, viruses, bugs or telephone malfunction or other such causes. The Promoter has no responsibility for any malfunction, delay, loss or damage caused by its website, its malfunction, or the actions of its administrators. Proof of transmission will not be accepted as proof of receipt.

Copyright

1. Copyright in all images submitted for this competition remains with the respective entrants. However, in consideration of their providing the competition prizes, each entrant grants a worldwide, irrevocable, perpetual licence to the Promoter, BA and Small Luxury Hotels™ to feature any or all of the submitted images in any of their publications, their websites and/or in any promotional material connected to this competition, including on bahighlife.com website.

Voting

1. Once submitted, photographs will appear on the BA High Life website and will be open to a public vote. Voters can vote on their favourite photographs (limited to one vote per photograph), by giving them a score between 1 – 5 (1 = lowest, 5 = highest).

2. You can only vote for an image once. No third party or bulk votes are permitted. If it becomes apparent, or the Promoter reasonably suspects that individuals are attempting to cast multiple votes, for example by using multiple e-mail addresses, these individuals and their votes will be disqualified. The Promoter reserves the right to disqualify entrants, if it appears that they have attempted to circumvent these rules, and no prizes will be awarded to these entrants.

Selecting the Winners

1. At the end of each Season, two winners will be selected to win the Season Prize, one of whom will be selected by the Voters (based on the highest number of points received in the relevant Season) and the other selected by a panel of judges comprised of: Lucy Perceval (High Life picture editor), Rankin (Photographer), Harriet Cooper (High Life acting Editor) and Paul Kerr (CEO of Small Luxury Hotels of the World™) (the “Panel”). The Panel will choose the winners based on the photographs that they think are the most original, visually appealing and well executed. There will be a total of six (6) Season winners (three (3) People’s choice and three (3) Judge’s choice winners).

2. The Ultimate Prize winner will be selected by the Panel, from the six Season winners, based on the photograph that they think is the most original, visually appealing and well executed. The Judges’ decision is final, and no correspondence will be entered into.

3. The Season winners will be contacted by email within 28 days of the relevant Season closing date. The Ultimate Prize winner will be contacted by email by 27 July 2012. The winners must indicate their acceptance of the prize, in the manner prescribed in the email, within 7 days of receiving. In the event of failure to do so within 7 days of the email, the Promoter reserves the right, in its absolute discretion, to select an alternative winner.

4. For the Season prize, in the event that there are two or more highest point scoring People’s choice entrants, the Panel will select the People’s Season winner, based on the criteria stated above.

5. A list of all the winners' names and winning photos will be available on www.bahighlife.com from 28 July 2012, or alternatively, the list of names can be obtained by sending a stamped self-addressed envelope to: BA Highlife Photography Competition, Cedar Communications Ltd, 85 Strand, London WC2R 0DW, between 30 June and 30 September 2012.

Prizes

1. Each Season Prize winner will receive one new Olympus PEN Lite camera, worth £550. Recorded delivery is included, but the Promoter accepts no responsibility for the loss of, or damage to the prize in the post.

2. The Ultimate Prize winner will receive:

  • The precise North American destination will be notified by the Promoter, on www.bahighlife.com, once final arrangements have been confirmed by the Promoter.
  • A minimum of two nights stay on a half board basis in a standard double room, at one of the hotels owned by Small Luxury Hotels™, as selected by the Promoter.
  • Meals are included, as well as all transfers within the UK (to and from the airport), but note that other incidental expenses are not included
  • A one-day session with a High Life photographer on assignment. Please note that the opportunities on the day will depend on the photographer and circumstances of the shoot, the subject of the assignment and photographer availability.

3. The Ultimate Prize must be taken by 31 December 2012. The dates for the Ultimate Prize will be subject to the availability and schedule of the Highlife photographer, and the availability of flights. Entrants accept that if they are the Ultimate Prize winner, they must be flexible and cooperate with the Promoter to arrange a suitable date. In the event that a suitable date cannot be agreed, despite the winner and the Promoter’s best efforts, or the Ultimate Prize cannot be provided by the Promoter for any reason outside of its control, the Promoter reserves the right to offer the winner an alternative prize, to the approximate value of the original prize.

4. All passengers are carried by BA in accordance with its Notice and Conditions of Contract as stated on each ticket and its General Conditions of Carriage for Passengers and Baggage (a copy of which is available on ba.com).

5. All prizes are subject to availability. Prize flights are subject to availability and capacity control. BA reserves the right to limit the number of prize travel seats available on any flight. It is possible that there will be no prize travel seats allocated on a particular service or the flight may be fully booked for prize travel seats, even though other seats are still available in the same cabin. Neither BA nor the Promoter accepts any responsibility in the event that the winner is unable to book their preferred flight(s).

6. Travel on BA franchisee, codeshare and alliance airlines, is not included in the prize. Once booked, no changes can be made to tickets.

7. The winner is responsible for supplying valid passports and visas and obtaining inoculations that may be required to visit the destination that is their prize. BA recommends that all passengers consider travel and medical insurance prior to commencing any flight.

8. Prize flights cannot be used in conjunction with any BA Miles programme, and other discount, discount coupon(s) or voucher(s), promotion(s), or special offer(s), by BA or jointly with any other organisation, bonus, awards or certificates. No BA Miles or partner miles will be awarded for travel under this promotion.

9. In addition, the winner is responsible for any income or use tax assessed in connection with the prize, and may receive tax documentation from the Promoter reflecting the retail value of the prize, which is estimated at £550 GBP for the Season Prize and £4000 for the Ultimate Prize.

10. The Promoter reserves the right to provide substitute prizes of similar value, should the specified prizes become unavailable for reasons beyond its control. Prizes are non changeable and non transferable. No cash or credit alternatives are offered. No upgrades are allowed. All third party terms and conditions relating to the prize apply.

Personal data

1. Personal data will be taken where necessary from all entries received but shall be limited to those details reasonably necessary for the administration of the competition. This information may be shared with any other third parties reasonably involved in the competition without liability to the Promoter or such third parties.

2. By entering this competition you consent to being contacted by Small Luxury Hotels™ about relevant products or services and research via email, unless you have opted out (which you can do when entering your details and photograph). If you have not opted out, you can still do so at any time via the unsubscribe link in the Small Luxury Hotels™ emails you receive.

Publicity

1. Except where prohibited, participation in the promotion constitutes the winner’s consent to the Promoter’s and its agents’ use of winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration for advertising and future promotional purposes without additional compensation. The potential winner may be required to execute an Affidavit of Eligibility, a Liability Release, and (where imposing such condition is legal) a Publicity Release (collectively, “Prize Claim Documents”). If any potential winner fails or refuses to sign and return all Prize Claim Documents within ten (10) days of prize notification, the winner may be disqualified and an alternate winner may be selected.

Other terms

1. The Promoter reserves the right to cancel or amend without notice the terms of this promotion and any tickets issued in the event of major catastrophe, war, earthquake or any actual or anticipated or alleged breach of any applicable law or regulation or any other circumstance beyond the promoter’s control in its sole discretion. The Promoter reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the promotion or to be acting in violation of these Terms and Conditions or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any pers to seek damages from any such person to the fullest extent permitted by law. The Promoter’s failure to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.on to deliberately undermine the legitimate operation of the promotion may be a violation of criminal and civil law, and, should such an attempt be made, the Promoter reserves the right

2. By receipt of any prize, the winner agrees to release and hold harmless the Promoter, and its respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of its respective parent companies and each such company’s officers, directors, employees and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the promotion or receipt or use or misuse of any prize. Nothing in this clause shall serve to limit or exclude the Released Parties liability for death or personal injury caused by that Released Party’s negligence or breach of these terms and conditions.

3. The Promoters are in no way liable for the reproduction or indirect access via third party web sites or home page access or where any reproduction misstates or omits any of the information or terms and conditions connected with the competition.

4. This competition is governed by English law and is subject to the exclusive jurisdiction of the English Courts.
